RESOLUTION NO. 990
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA GRANTING AN EASEMENT ON
A PORTION OF CITY O~~ED PROPERTY KNOWN
AS VILLAGE PARKING DISTRICT NO. 1 TO
PACIFIC GAS AND ELECTRIC COMPANY FOR
PUBLIC UTILITY PURPOSES
WHEREAS, the City of Saratoga is the owner in fee of
certain real property located within the City of Saratoga, commonly
known as Village Parking District No.1, and
WHEREAS, the Pacific Gas and Electric Company is a
public utility rendering utility services to persons residing
within the city limits of the City of Saratoga; and
WHEREAS, the Pacific Gas and Electric Company has
requested that the City of Saratoga grant to Pacific Gas and Electric
Company an easement for underground public utility use across a por-
tion of said public property known as Village Parking District
No.1 in the form attached hereto marked Exhibit "A"; and
WHEREAS, the proposed easement attached hereto marked
Exhibit "A" has been presented to the City Council and the City
Council has read and reviewed said easement.
THE CITY COUNCIL OF THE CITY OF SARATOGA DOES HEREBY
RESOLVE that pursuant to Government Code Section 50335, the City
of Saratoga hereby grants to the Pacific Gas and Electric Company, a
California corporation, an easement across a portion of real property
owned by the City of Saratoga commonly known as Village Parking
District No. 1 in the form and as more particularly described in
Exhibit "All attached hereto and incorporated herein by reference.
Said easement shall be used solely as a public utility easement
and uses appurtenant thereto.

I hereby certify the foregoing to be a true, full and
correct copy of a resolution duly passeD and adopted by the City

EASEMENT
CITY OF SARATOGA, a public body of the State of California,
first party, hereby grants to PACIFIC GAS AND ELECTRIC CO~ANY, a California
corporation, second party, an easement for public utility purposes and uses
appurtenant thereto including but not limited to, the right from time to time
to construct, insta11,inspect, maintain, replace, remove and use facilities
of the type hereinafter specified, together with a right of way therefor, within .
a strip or parcel of land or along a route as hereinafter set forth, and also
ingress thereto and egress therefrom, over and across the lands situate in the
City of Saratoga, County of Santa Clara, State of California, described as
follows:

The parcel of land described and designated PARCEL ONE in the deed
from Frances B. Anderson to City of Saratoga dated December 11, 1967
and recorded in Book 7961 of Official Records at page 60, Santa Clara
County Records.
Said facilities shall consist of:
Such underground conduits, pipes, manholes, service boxes, wires, cables and electrical
conductors; aboveground marker posts, risers, and service pedestalsj underground and
aboveground switches, fuses, terminals and transformers with associated concrete pads;
and fixtures and appurtenances necessary to any and all thereof, as second party deems
necessary located within the strip of land described as follows:
A strip of land of the uniform width of 10 feet lying 5 feet on each side of
a line which begins at a point outside the boundary lines of said lands and
runs thence north 46° 42' west 2.4.5 feet; thence north 160 2.5' east
approximately 75 feet to a point in the northeasterly boundary line of said
lands; said point of beginning bears south 410 34W west 97.1 feet distant
from the northwesterly terminus of a course in tbe center line of Fourth
Street, as shown upon the Record of Survey Map filed for record in Book
228 of maps at page 50, Santa Clara County Records, which course

according to the bearings and distances shown upon said map, has a
bearing of N 470 00' 00" W and a length of 143.67 feet; the side lines of
said strip shall be lengthened or shortened at the northeasterly terminus
thereof so as to terminate in the northeasterly boundary line .of said lands;
excepting therefrom the portion thereof lying outside the bqundary lines
of said lands. f
