HomeMy WebLinkAboutCity Council Resolution 10643/16/82 RESOLUTION NO. 1064 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA APPROVING THE NEGATIVE DECLARATION AND ADOPTING CERTAIN FINDINGS IN CONNECTION WITH THE PROPOSED REZONING OF THE CONGRESS SPRINGS SCHOOL SITE (APN 391-4-11) FROM AGRICULTURAL TO R-1-12,500 WHEREAS, the Saratoga Union School District is the owner of a certain 10.58 acre parcel of property located at the north- western corner of the intersection of Via Escuela Drive and Glen Brae Drive commonly known as Congress Springs School and as shown on Exhibit "A" attached hereto and incorporated herein by reference; and WHEREAS, the City of Saratoga received an application from the Saratoga Union School District to rezone this parcel from a zoning district designation of "A - Agricultural" to "R-1-12,500"; and WHEREAS, on January 13, 1982, a proposed amendment to the Zoning Map was presented to the Planning Commission at a regular meeting in the form marked Exhibit "B" attached hereto, and at said meeting a duly noticed public hearing was held on said proposed amendment; and WHEREAS, after the closing of said public hearing and consideration of said proposed amendment, the Planning Commission adopted a resolution recommending that the City Council adopt the proposed amendment to the Zoning Map of the City of Saratoga; and WHEREAS, the City Council of the City of Saratoga, at a regular meeting on March 3, 1982, held a duly noticed public hearing on the proposed amendment and, after the closing of said public hearing, reviewed and considered said proposed amendment and the negative declaration prepared by the staff in connection therewith; NOW, THEREFORE, the City Council of the City of Saratoga RESOLVES as follows: 1. The Council has reviewed and considered the negative -1- declaration prepared by the staff in connection with said rezoning together with any comments received during the public hearing process, and hereby approves the said negative declaration (Exhibit C). 2. Having heard the evidence presented, both written and oral, the City Council of the City of Saratoga hereby makes the following findings in connection with the proposed amendment to the Zoning Map - City of Saratoga: (a) The present zoning on the subject property is inconsistent with the General Plan as amended, and, therefore, a rezoning of the subject property is required to bring the ~oning Ordinance into conformity with the General Plan. (b) The rezoning is required to achieve the objectives of the Zoning Ordinance as prescribed in Section 1.1 of said Ordinance. The project is an infill projedt which wo~ld not require any significant extension of urban services. The open ppace/recreation value provided by ~e site can be maintained by prese'rving a portion o~ it in open space or by requiring an in lieu fee to improve' other existing open space resources.
