HomeMy WebLinkAboutCity Council Resolution 1078 RESOLUTION NO. 1078 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA OPPOSING IMPLEMENTATION OF AB 1253 VPHEREAS, the California State Legislature has enacted AB 1253 and the Governor has signed it into law, and WHEREAS, AB 1253 reduces the amount of employer contributions for school districts, county superintendents of schools, community college districts and State employees totaling $187 million, and WHEREAS, AB 1253 reallocates the $187 million from the PERS Reserve for Deficiencies in order to help balance the State budget for 1981-82, and WHEREAS, this rescue results from the employer contributions of all member agencies, not merely the State and school districts, and WHEREAS, implementation of AB 1253 should be opposed because it is fiscally imprudent and establishes a dangerous precedent that could lead to further "raiding" of the retirement system to the financing of the, zState budget; and WHEREAS, PERS Fund is held in trust by the State and must be used solely and equitably for the benefit of its members, retirees and survivors, THEREFORE, BE IT RESOLVED by the City Council of Saratoga that: 1) implementation of AB 1253 should be stopped, and that the PERS Board of Administration should refuse to make transfers required by AB 1253 unless ordered to do so by an Appellate Court, and 2) if the Appellate Court finds that AB 1253 is lawful, the benefits of the use of these reserves should be available on an equal basis to all member agencies in proportion to their contributions.
