RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA UPHOLDING A DECISION OF THE PLANNING
COMMISSION AND DENYING DESIGN REVIEW FOR A-861
WHEREAS, the applicant, Gerald Butler, has requested Design
Review Approval to construct a two-story single family dwelling;
and
WHEREAS, on March 23, 1983, and April 13, 1983, the Planning
Commission held a public hearing on applicant's request for Design
Review Approval and after said public hearing denied said request;
and
WHEREAS, applicant has appealed the Planning Commission's
decision to the City Council; and
WHEREAS, on May 18, 1983, the City Council held a de novo
public hearing and after the closing of said public hearing
reviewed and considered the applicant's request, staff reports,
and other evidence, both written and oral, presented to the
Council during said public hearing;
NOW, THEREFORE, the City Council of the City of Saratoga at
its May 18, 1983, meeting by a unanimous vote by Councilmembers
Callon, Clevenger, Fanelli, Mallory and Moyles did resolve as
follows:
1. The applicant' s appeal from the Planning Commission was
denied and the decision of the Planning Commission was upheld.
2. Design Review Approval for A-861 was denied, the City
Council being unable to make all of the findings as required under
the Design Review Ordinance.
The above and foregoing resolution was passed and adopted at
a regular meeting of the City Council of the City of Saratoga held
on the 1st day of June 1983, by the following vote:
AYES: Counci]~s Clevenger, Fanelli, MDyles, Mayor Callon
NOES: None
ABSENT: Councilmember MaIlory
ABSTAIN: None
