RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SARATOGA
REVERSING
A DECISION OF THE PLANNING COMMISSION
WHEREAS, HAP CAMPBELL and VICKI VAN VALER, the applicants, have
applied to the City of Saratoga for Design Review and Variance approval to
construct a third story addition to a single-family dwelling which maintains a front
yard setbck of 16 feet where 25 feet is required, such application being identified as
V-605 and A-g57, and
WHEREAS, on February 23, 1983 and April 13, 1983, the Planning Commission
of the City of Saratoga conducted a public hearing on said application, and following
the conclusion thereof, the Planning Commission approved the application; and
WHEREAS, GAYLEN LEISHMAN, DR. GALIN K. LEISHMAN and BETTY
LE1SHMAN have appealed the decision of the Planning Commission to the City
Council; and
WHEREAS, on 3une 1, 1983, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given
an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in
support of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting
on :June 1, 1983, by a vote of 3-1 with Councilmember Fanelli dissenting, did resolve
as follows:
1. The appeal from the Planning Commission was upheld and the decision of
the Planning Commission was reversed.
2. Design Review Approval for A-857 and Variance Approval for V-605
were denied, without prejudice, the City Council being unable to make
the findings concerning avoidance of unreasonable interference with
views and privacy, minimization of excessive bulk and height, and
compatibility with neighborhood, as required under the Design Review
Ordinance.
3. In the event a new application for Design Review Approval of a revised
project on the same site is filed by the applicants within six months from
3une 1, 1983, the application fee shall be waived.

The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 15th day of
Jtme ., 198 3 , by the following vote:
