RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
AUTHORIZING NOTICE OF INTENTION TO PURCHASE OR LEASE
SURPLUS SCHOOL SITES OFFERED BY THE MORELAND SCHOOL DISTRICT
WHEREAS, pursuant to the "Naylor Act" (Title 2, Part 23, Chapter 3,
Article 5 of the California Education Code), the Moreland School District
has offered for purchase by the City of Saratoga a surplus school site
consisting of approximately 11.57 acres located at 12301 Radoyka Drive,
Saratoga, California, commonly known as the Brookview School; and
WHEREAS, it is the desire of the City of Saratoga to preserve exis-
ting school sites for recreation and open space uses; and
WHEREAS, the City Council hereby finds that public lands within the
northeast area of the City, including the vicinity of the Brookview School
and the E1 Quito School are inadequate to meet the exisitng and foreseeable
needs of Saratoga residents for playground, playing field or other recrea-
tional and open space purposes,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Saratoga as follows:
1. That the City Manager be, and hereby is authorized and
directed to furnish a written notice to the Moreland
School District of the City's intention to purchase or
lease the surplus land, or portion thereof, or other
surplus property offered by said district in substitution
therefor, such notice to be accompanied by a copy of this
Resolution.
2. That the City Manager be, and he hereby is authorized and
directed to commence negotiations on behalf of the City
with the Moreland School District for purchase or lease of
surplus land owned by said District.
3. That the City Manager shall, within 60 days after adoption
of this Resolution, render a report and recommendations to
the City Council for further action.
The above and foregoing resolution passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 3rd day
of August, 1983, by the following vote:
AYES: Councilmembers Callon, Clevenger, Fanelli, Mallory and
Mayor Moyles
NOES: None
