HomeMy WebLinkAboutCity Council Resolution 2129 TEMPORARY AND ~M RATE INCREASE UNDER THE FRANCHISE AG~RR.M~gT WITH G~F~N VAT.TRY DISPOSAL COMPANY WHEREAS, pursuant to the Franchise Agreement dated March 8, 1983, between Green Valley Disposal Crmpany, Inc. ("Green Valley") and the City of Saratoga, Green Valley has requested certain increases in the rates charged to its custcrers; and WHEREAS, after careful review by the City Council of the documentary and oral evidence sukmitted by Green Valley in support of its request, and the evaluation thereof by the Saratoga Finance Ccnm~ittee, the City Council has determined that such evidence is insufficient at this time to justify approval of the request; and WHEREAS, the City Council has concluded that a temporary and interim rate increase is appropriate until further study of the request is completed and a final decision is rendered by the City Council. NOW, THEREFORE, IT IS HEREBY RF2~LVED by the City Council of the City of Saratoga as fol lc~s: 1. The City Council hereby approves the rates set forth in the schedule attached hereto as Exhibit "A", representing an increase of ten percent (10%) above current charges, such rates to be effective as of March 1, 1984, and to remain in effect as a temporary and interim rate increase until a final decision on the request is rendered by the City Council. 2. The City Manager is hereby authorized to employ an independent certified public accountant to be selected by the City Council, having experience in the preparation and audit of financial records for solid waste disposal cc~panies. Said accountant shall perform an audit of the books and records of Green Valley covering such expenses, transactions, and other matters as directed by the Saratoga City Council. Green Valley shall be responsible for payment of such audit costs as may be required under the terms of the franchise agreement, and the balance of any cost shall be paid by the City. 3. In the event the City Council subsequently approves a further increase in any or all of the rates set forth in Exhibit "A", such increase may be retroactive to March 1, 1984, and shall be collected by Green Valley from its customers on billings rendered after the date of final decision by the City Council on the rate increase request. The method of collecting any retroactive charges shall be determined by mutual agreenent between the City and Green Valley.
