HomeMy WebLinkAboutCity Council Resolution 2145 RESOLUTION NO. 2145 RF~OLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA AFFIRMING A DECISION OF THE PLANNING COMMISSION WHEREAS, on or about April 12, 1977, the City Council of the City of Saratoga granted to Lillian Rodoni use permit No. 315, subject to compliance with certain conditions as set forth in Exhibit "A" attached thereto; and WHEREAS, by letter dated January 11, 1984, written notice was given to the property owner that proceedings to revoke use permit No. 315 were being initiated as a result of the failure to comply with the conditions of said use permit; and WHEREAS, after hearings conducted by the Planning Commission on February 8, 1984, and March 14, 1984, during which it was found and determined by the Planning Commission that the conditions of the use permit still had not been fully satisfied, the Planning Commission voted unanimously to revoke use permit No. 315; and WHEREAS, an appeal from the decision of the Planning Commission was taken by the Estate of Lillian Rodoni to the Saratoga City Council and a de novo hearing was conducted by the City Council at its regular meeting on May 2, 1984, at which time any person interested in the appeal was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission concerning the revocation of said use permit, together with the written and oral evidence presented to the City Council on behalf of the appellant; and WHEREAS, the City Council found that the appellant has continuously failed to satisfy the conditions of said use permit, despite being given numerous opportunities and extensions of time to do so, and no justifiable reason has been provided to excuse such noncompliance, NOW, THEREFORE, the City Council of the City of Saratoga, at its regular meeting on May 2, 1984, by a unanimous vote, denied the appeal and upheld the decision of the Planning Commission to revoke use permit No. 315. In the event the use described in U.P. 315 is not discontinued within 30 days from the date of this resolution, the City Attorney is hereby authorized and directed to initiate appropriate legal proceedings. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 16th day of May, 1984, -]- by the following vote: AYES: Councilmeml~rs Clevenger, Mallory arfi Mayor Moyles NOES: None ABSENT: Councilmebers Callon and Fanelli~ ATT~;ST: EEPLTY CITY CLERK -2-
