HomeMy WebLinkAboutCity Council Resolution 2170 RESOLUTION NO. 2170 RESOLLrrION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION OF THE PLANNING COMMISSION WHEREAS, ROBERT DEWEY, the applicant, has applied to the City of Saratoga for design review approval and site modification approval for a new two- story single family residence located at 12329 Vista Arroyo, such project being identified as A-958, and WHEREAS, on May 9, 1984, and May 15, 1984, the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission approved the application; and WHEREAS, RUSSELL CROWTHER has appealed the decision of the Planning Commission to the City Council; and WHEREAS, on June 20, 1984, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council referred the matter back to the Planning Commission to consider suggested modifications to the design of the residence and the feasibility of relocating the structure on the site in order to minimize the impact on the ridge line, with the City Council reserving jurisdiction on the appeal pending further recommendation from the Planning Commission; and WHEREAS, on July 25, 1984, the Planning Commission reviewed modified drawings showing relocation of the structure on the site and other changes designed to minimize the perception of bulk and visibility of the proposed residence on the ridge line and the Planning Commission recommended to the City Council that such modified drawings be approved; and WHEREAS, at a continued regular meeting on August 7, 1984, the City Council reviewed and considered the recommendation from the Planning Commission together with the staff reports, minutes of prior proceedings conducted by the Planning Commission relating to the application, and the written and oral evidence presented to the Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its continued regular meeting on August 7, 1984, by a vote of three to one with Councilmembers Fanelli, Moyles and Hlava voting in favor and Councilmember Clevenger dissenting, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The Council found and determined that as a result of the modifications to the drawings and reloeation of the structure on the -1- site, the applicant had complied with the standards of the design review ordinance and the applicable policies of the City pertaining to The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 15th day of August, 1984, by the following vote: AYES: Councilmembers Clevenger, Hlava, bJoyles and Mayor Fanelli NOES: None ABSENT: None ABSTAIN: Councilmenber Callon t ATTEST: DEP C~T~]TYCLER~ ~ "
