HomeMy WebLinkAboutCity Council Resolution 2201 RBSOLUTION NO. 2 2 0 1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA lIPHOLDING AN ADMINISTRATIVE DECISION OF THE DIRECTOR O~F COMMUNITY DEVELOPMENT WHEREAS, AUGUST JOHN BOISSERANC, the applicant, has applied to the City of Saratoga for a business license to engage in the sale of Christmas trees at 13650 Saratoga-Sunnyvale Road and 21511 Big Basin Way, and WHEREAS, the Director of Community Development has refused to issue such license on the ground that the proposed business activity is not permitted by the zoning regulations applicable to the premises where such activity will be conducted, and WHEREAS, the applicant has appealed the decision of the Director to the City Council; and WHEREAS, on December 5, 1984, the City Council conducted a de novo hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on December 5, 1984, by a vote of 4-1, with councilmember Clevenger dissenting, did resolve as follows: 1. The appeal from the administrative decision of the Director of Community Development was denied and the decision of the Director was affirmed. 2. The council was unable to find any authorization in the zoning ordinance for the proposed business activity to be conducted upon the app]ieant's property, The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 19th day of December, 1984, by the following vote: AYES: Counc~s Clevenger, Hlava, Moyles and Mayor Fanelli NOES: None ' ~' '~AYOR ' ' ' ATTEST: DEPUTY CIC~~LERK 6<, %
