HomeMy WebLinkAboutCity Council Resolution 779.1 ]~SOLLTIC~ NO. 779.1 A RESOLUTION (F T~E CITY CUa~IL OF THE CITY OF SARATOGA A~MM)ING ~ESGLUTION N0. 779 WHEREAS, the City of Saratoga has undergone a number of organizational changes affecting personnel and their duties since its 'Conflict of Interest Code was adopted by Resolution No. 779 in 1976, and WHEREAS, the Conflict of I~st ~Code includes the City Council and the City Manager as public officials required to!disclose economic interests, although the Political Reform Act itself now includes the City Council and City Manager as officials mequired to disclose such interests, and WHEREAS, the City. Council therefore deems it advisable to add to its Conflict of Interest Oode various' positicms which entail the making or participation in the making of decisicals which may 'foreEly have a material effect on any financial intemestand to delete those 'positions already included in the Political Reform Act. NC~, T}~aEEDRE, BE IT RESC~VED, that Sections 2, 3 and 4 of Resolution 779 are hereby amende~ to read as follows: SECTION 2: APPLICATION {F OODE. This Conflict of Interest Code shall be appi~'Cable to the 'Ommunity Development Director, Cnm~mity Services D.iVect~_.r, Finance Director, Maintenance D~ector, Planning Director, and City AttOrney. SECTION 3: DISC[DE. All persons described in Section 2 shall be ~equired to disClose inves~ts, interests in real property and inccme. No other or no additional disclosure requirene~ts are imposed by this Conflict of Interest 'Code. SBETION 4: CI~CtA~'~MCES R~QUIRING DISQUALIFICATION. Any person ~scribed in Section '2 must disqualify himself or herself frcm making or. participating in the making of any decisions which will foreseably have a material fi/lan~ial effect, distinguishable from its effect on the public generally, on any e3Drnnic interest, as defined in Gove/~ent Code Section 87103. No such persc~ shall be prevented frcm making or participating in'~ making of any decisic~ to the extent his or her participation is' legally requ/xBd for the decision to be made.
