RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA UPItOLDING A DECIS[ON OF T[IE PLANNING
COMMISSION
WHEREAS, PAUL HEAT}], the applicant, has applied to the City of
Saratoga for a use permit to allow construction of a storage building within 15 feet
from the property line, and design review approval of such structure, to be located at
14311 Quito Road, such applications being identified as UP 578 and A 1087, and
WHEREAS, on April 24, 1985, the Planning Commission of the City of
Saratoga conducted a public hearing on said applications, and following the conclusion
thereof, the Planning Commission approved the applications; and
WHEREAS, JOHN and PATRICIA POPE have appealed the decision of the
Planning Commission to the City Council; and
WHEREAS, on June 5, 1985, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
applications, and the written and oral evidence presented to the City Council in
support of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga at its
meeting on June 5, 1985, by a vote of two to one with Councilmember Moyles
dissenting and Councilmembers Fanelli and Callon being absent, did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was upheld.
2. The City Council was able to make all of the findings required for the
granting of a use permit and design review, as described in the staff
report dated April 24, 1985.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 19th day of June,
1985, by the foliowing vote:
