HomeMy WebLinkAboutCity Council Resolution 2268 RESOLUTION NO. 2268 R~OLU~ON OF THE CITY COUNCIL OF THE CITY OF SARATOGA REVMR~ING AN ADMINIgrRATIVE DECISION OF THE DIRECTOR OF COMMUNITY DEVELOPMENT WHEREAS, JAMES and PAMELA PERISHO, the applicants have applied to the City of Saratoga for a tree removal permit to remove two Monterey Pine and two Cedar trees from the property located at 21185 Tollgate Road, and WHEREAS, on July 5, 1985, the Director of Community Development approved the issuance of a permit for removal of two Monterey Pine trees and one Cedar tree and denied a permit for removal of the second Cedar tree; and WHEREAS, the applicants have appealed the decision of the Director to the City Council; and WHEREAS, on August 7, 1985, the City Council conducted a de novo hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga at its meeting on Augur 7, 1985, by a vote of four to zero with Councilmember Fanelli absent, did resolve as follows: 1. The appeal from the administrative decision of the Director of Community Development was upheld and the administrative decision was reversed. 2. The City Council found that the site already contains numerous trees to the extent of being overplanted, and removal of the Cedar tree in question would not cause any adverse impacts. Removal of such tree is necessary for the applicants' intended use and enjoyment of the property. The above and foregoing resolution was passed and adopted at a regular -1- meeting of the City Council of the City of Saratoga held on the 21st day of August, 1985, by the following vote: AYES: Councilmeters Fanelli, Hlava, MDyles and Mayor Clevenger NOES: None ABSENT: Councilmenber Callon ayor ATTEST: City Clerk -2-
