RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA CALLING
SPECIAL ELECTION F(m THE PtMLPOSB OF SUBMITTING TO THE ~ OF THE CITY
ADVISORY MFASURE ~IlqG HIGEWAY 85
~, the City Clerk received an Initiative Petition signed by not less than
15% of the voters of the City accordir4~ to the Santa Clara County Registrar of
Voter's last official report of reSistratios to the Secretaz7 of State, and,
WHEREAS, this petition was certified as to the number of signatures on
February 13, 1986, by the Santa Clara County Registrar of Voters, and
WHEREAS, the City Attorney of the City of Saratoga has determined that the
measure does not constitute a proper initiative within the requirements of
State law, but the measure could be placed on the ballot as a non-binding
advisory opinion, and
W~, the City Council has therefore determined not to adopt said measure as
an ordinance, nor to submit said measure as an initiative ordinance, but to
submit the same to the voters of the City as an advisory measure at the next
regular municipal election to he held in this City on June 3, 1986.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Saratoga as
fol lows:
SECTION 1: All the statements in the preamble to this resolution are hereby
referred'~ as findings of this body, and are incorporated herein by reference.
SECTION 2: Pursuant to Elections Code Section 5353 a special election shall
be and is"hereby ordered to be held in the City of Saratoga on June 3, 1986,
at which election there shall be submitted to the qualified electors of the
City the followin~ measure:
"It is hereby declared to be the legislative policy of the City of
SararoSa to o~se the construction of a freeway and/or hiMhway in
the West Valley or Route 85 corridor through the City. The City
Council shall therefore take all reasormble and practical measures
to defeat such c(x~truction."
SECTION 3: The City Clerk of the City of Saratoga is hereby authorized and
d"i~ectea'to certify to the due adoption of this resolution and to transmit a
copy thereof so certified to the Board of Supervisors of Santa Clara County and
to file a copy thereof so certified with the County Clerk of said County.
The above and foregoing resolution was passed and adopted at a regular
adjourned meeting of the Saratoga City Council held on the 25th day of
February, 1986, by the followin~ vote:
