RESOLUTION NO: 2328 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION O1~ THE SITE REVIEW COMMITTEE WHEREAS, Mr. and Mrs. John Hamm, the applicants, have applied to the City of Saratoga for design review approval to construct a second story expansion to the residence located at 14104 Okanogan Drive, Saratoga, California, such application being identified as A-1169, and WHEREAS, on February 26, 1986, the Site Review Committee of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Site Review Committee approved the application; and WHEREAS, Thomas and Linda Parker have appealed the decision of the Site Review Committee to the City Council; and WHEREAS, on April 2, 1986, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Site Review Committee relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on April 2, 1986, by a vote of 4-0 with Councilmember Clevenger absent, did resolve as follows: 1. The appeal from the Site Review Committee was denied and the decision of the Site Review Committee was affirmed. 2. The evidence presented did not support the claim by appellants that the proposed expansion would constitute an unreasonable invasion of privacy. Landscaping now exists and additional landscaping will be installed to screen the two residences. In addition, a distance in excess of 100 feet separates the windows of the addition from the glass door wall in appellants' bedroom and there is no clear view from one structure to the other. Any potential privacy impact can be mitigated. 3. As a condition of approval, the applicants shall install the landscaping between the residences prior to occupancy, in accordance with the landscape plan to be approved by staff as provided in Condition No. 1 of the Staff Report dated February 14, 1986. -1- The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 16th day of April, 1986, by the following vote: AYES: Councils Callon, Fanelli, Moyles and Mayor Pro Ten Hlava NOES: Ncne ABSENTMayor Clevenger / ATTEST: CITY CLERK -2-
