A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SARATOGA CANCELLING FINAL BUILDING SITE APPROVAL
FOR SDR-156~ AND AUTHORIZING KELEASE OF
PERFORMANCE BOND AND PARTIAL REIMBURSEMENT OF
FEES
WHEREAS, Ejub Ferhatbegovic ("the Applicant") applied to the City of
Saratoga for building site approval to permit an expansion exceeding 50% of the
existing single-family residence located at 1287 1 Pierce Road, such application being
identified as SDR-1568; and
WHEREAS, final building site approval was granted to the Applicant by the
Saratoga City Council on November 7, 1984, and, in connection therewith, the
Applicant delivered to the City performance and payment bonds for deferred
improvement work and paid engineering and inspection fees as required under the
City's Subdivision Ordinance; and
WHEREAS, the Applicant has decided to reduce the quantity of
improvement work such that the total size of the addition will be less than 50% of the
existing structure; and
WHEREAS, by reason of such reduction below 50%, the Applicant would no
longer require building site approval and has requested that such approval be
cancelled,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF SARATOGA AS FOLLOWS:
1. The final building site approval for SDR-1568, as granted by the City
Council on November 7, 1984, pertaining to the property located at 14583 Big Basin
Way, is hereby cancelled and declared to be of no further force or effect.
2. The City Finance Director is hereby authorized and instructed to
refund to the Applicant the sum of $730, representing unused engineering and
inspection fees previously paid to the City by the Applicant. All other fees and costs
collected by the City in connection with the tentative and final building site approval
for SDR-1568 shall be retained by the City for services rendered and reimbursement of
costs incurred.
3. The performance and payment bonds deposited by the Applicant with
the City, including a cash bond in the amount of $1,000, are hereby released and shall
be returned to the Applicant.

Saratoga held on the 7th day of May, 1986, by the following vote:
