HomeMy WebLinkAboutCity Council Resolution 2366 RESOLUTION NO. 2366 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION OF THE PLANNING COMMISSION WHEREAS, THOMAS SUIT, the applicant, has applied to the City of Saratoga for a variance to permit construction of a detached garage having a six foot side yard setback where 10 feet is required, a 6 foot rear yard setback where 25 feet is required, and a height of 15-1/2 feet where 10 feet is allowed, upon the property located at 189 15 Devon Avenue, such application being identified as V-735, and WHEREAS, on June 17, 1986, the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission approved the application subject to a condition that a portion of the structure extending beyond the westerly wall of the garage be removed; and WHEREAS, the applicant has appealed the condition imposed by the Planning Commission to the City Council; and WHEREAS, on August 6, 1986, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on August 6, 1986, by a vote of 5-0 did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The condition was found to be a reasonable compromise between the interests of the applicant and the objections of the neighbor, particularly in view of the fact that the structure was illegally constructed without a building permit. The condition will serve to mitigate the impact of the structure upon the neighboring property by reducing its size and bulk. -1- The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 3rd day of September, 1986, by the following vote: AYES: Councilmembers Anderscn, Clevenger, Moyles, Peterson, and Mayor Hlava NOES: Nc~e ABSENT: Nc~le ~ _~ ~,-(kA3 ~ N~YOI~ ' ATTEST: CITY CLERK -2-
