HomeMy WebLinkAboutCity Council Resolution 2367 RESOLUTION NO. 2367 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION O:P THE PLANNING COMMON WHEREAS, BRIAN KELLY DEVELOPMENT, the applicant, has applied to the City of Saratoga for tentative map approval for a 5 lot subdivision of the property located at 13500 Saratoga Avenue, such application being identified as SDR-1622, and WHEREAS, on June 25, 1986, the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission approved the application subject to a condition that all of the residences to be constructed shall be single-story; and WHEREAS, the applicant has appealed the condition imposed by the Planning Commission to the City Council; and WHEREAS, on August 6, 1986, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on August 6, 1986, by a vote of 3-2 with Councilmembers Moyles and Peterson dissenting, did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The condition that all residences within the subdivision be single- story was found to be a reasonable mitigation measure to preserve the character and integrity of the neighborhood, which is predominately comprised of single-story homes, and the views currently enjoyed by the occupants of adjacent properties. Each of the lots within the subdivision exceeds the minimum standard of 20,000 square feet and therefore provides sufficient area for the construction of a single-story structure. -1- The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 3rd day of September, 1986, by the following vote: AYES: Councilmembers Anderson, Clevenger, Moyles, Peterson, and Mayor Hlava NOES: Nc~e ABSENT: None ATTEST: CITY CLERK / -2-
