HomeMy WebLinkAboutCity Council Resolution 2377 RESOLUTION NO. 2377 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA APPROVING AND ORDERING ANNEXATION TO THE CITY OF CERTAIN UNINCORPORATED TERRITORY WHEREAS, HARBOR BUILDERS CO., INC., ("Petitioner") has submitted a petition for annexation to the City of Saratoga of certain real property located in the County of Santa Clara, as described in Exhibit "A," attached hereto and made a part hereof; and WHEREAS, the City Council is the duly designated conducting authority for proceedings to annex said property, pursuant to Section 56826 of the Government Code; and WHEREAS, in accordance with the provisions of Section 56826 of the Government Code the City Council has found and determined as follows: (a) That the petition has been executed by all of the owners of the territory to be annexed; (b) That the territory to be annexed is contiguous to the existing limits of the City of Saratoga and located within the urban service area of the City, as adopted by the Santa Clara County Local Agency Formation Corn m ission ("the Corn m ission'); (e) That the territory to be annexed is uninhabited, as defined in Section 56{)46 of the Government Code; (d) That the surveyor for the County of Santa Clara has determined the boundaries of said property to be definite and certain, and in compliance with any applicable road annexation policies of the Corn mission; (e) That the proposed annexation will not split lines of assessment or ownership; (f) That the proposed annexation will not create islands or areas in which it would be difficult to provide municipal services; (g) That the proposed annexation is consistent with the General Plan as adopted by the City; (h) That no conditions have been imposed by the Commission, or remain to be satisfied by the City, for inclusion of said property in the City's urban service area; (i) That the land use designation of the territory to be annexed, as contained in the City's General Plan, has not been changed from the time the City's urban service area was adopted by the Commission; and -1- WHEREAS, the proposed annexation is exempt from the requirements of the California Environmental Quality Act, NOW, THEREFORE, the City Council of the City of Saratoga hereby resolves and orders that the property described in Exhibit "A" attached hereto, be and the same hereby is reorganized and annexed to the City of Saratoga, such annexation to be effective on the date this resolution is adopted. The City Council, as conducting authority, reorganized such property as indicated above without notice or hearing, it being found that the territory annexed hereby is uninhabited and all of the owners of such territory have filed a written petition for the City Council to initiate such reorganization. City Clerk ~ ~ -2- COCCIARDI' ANNEXATION A-86-002 EXHIBIT "A" Beginning at an iron pipe at the section corner common to Section 34 amd 35, Township 7 South, Range 2 West, and Sections 2 and 3, Township 8 South, Range 2 West, Mount Diablo Base Meridian, said section corner being in the incorporation line of the City of Saratoga; thence along said incorporation Line and the section Line between Sections 34 and 35, Township 7 South, Range 2 West, Mount Diablo Base Meridian, N 0°16'2D" E 150.DO feet to an iron pipe at the Northeasterly corner.of that certain parcel of land conveyed by Vince Stotte'Garrod, et'ux, to Anthony Cocciardi and Mark Erickson by Deed dated Play 12, 1958 and recorded July 3D, 1958 in Book 4136 of Official Records at Page 332, Santa Clara County Records; thence continuing along said incorporation line )nd section line N 0°16'20" E 220.0D feet; thence leaving said incorporation line and section Line and running S 88°32'20" W 93.76 feet to a point in the easterly boundary of Mount Eden Road, 40 feet Wide as shown on the RecDrd of Survey recorded in Book 216 of Maps at Page 37, Santa CLara County Records; thence running along said Easterly boundary of Mount Eden Road S 20D54'33'° E 183.13 feet to a.point of tangency; thence along a curve to the right with an internal angle of 64°49'55", a radius of 17D.OD feet and a length of 192.36 feet to a point of tangency; thence S 43° 55'20'° W 27.82 feet to a point in the'~section 'line running between Section 34, Township 7 South,.Range 2 West and Section 3, Township 8 South, Range 2 West MDBM thence along said section line N 88~ 32m20'' E 82.3D feet to the aforementioned section corner in the aforementioned incorporation line of the City of Saratoga at the point of.beginning. Containing 0.392 acres and Lying within Section 34, Township 7 South, Range 2 West, MDBM, Santa CLara County, California.
