HomeMy WebLinkAboutCity Council Resolution 2385.1 RESOLUTION NO. 2385.1 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA RESCINDING RESOLUTION 2385 DESIGNATING THE CITY AS THE RESPONSIBLE AGENCY FOR ENFORCEMENT OF HAZARDOUS MATERIALS STORAGE REGU LAT I ON S WHEREAS, on October 29, 1986, the City Council adopted Resolution 2385 designating the City as the responsible agency for enforcement of hazardous materials storage regulations; and WHEREAS, the City of Saratoga, along with other cities in the County taking similar action, has been advised that a resolution of self-designation could not be adopted within the time constraint prescribed by State law, and as a result thereof, a serious question exists as to the validity of Resolution 2385; and WHEREAS, in order to avoid uncertainty with respect to the legal status of Resolution 2385, and pending clarification from State authorities and further action to be taken by the County of Santa Clara in connection with this subject, the Council deems it to be in the best interests of the City to rescind Resolution 2385. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Saratoga that Resolution 2385 be and the same hereby is rescinded and declared to be of no further force or effect. The above and foregoing resolution was passed and adopted at a regular meeting of the Saratoga City Council held on the 17th of December, 1986, by the following vote: AYES: Councilmembers Anderson, Clevenger, Moyles, Peterson, and Mayor Hlava NOES: None ABSENT: None ATTEST: k~ ~-~ Mayor Deputy City
