HomeMy WebLinkAboutCity Council Resolution 2390 RESOLUTION NO: 2390 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION OF THE SITE REVIEW COMMITTEE WHEREAS, MAHLON and BILL POOL, the applicants, have applied to the City of Saratoga for design review approval to construct a second story addition to an existing residence located at 20334 Thelma Avenue, such application being identified as DR-86-019, and WHEREAS, on September 10, 1986, the Site Review Committee of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Site Review Committee denied the application; and WHEREAS, on November 19, 1986, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Site Review Committee relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on November 19, 1986, by a vote of 5-0, did resolve as follows: 1. The appeal from the Site Review Committee was denied and the decision of the Site Review Committee was affirmed. 2. The City Council was unable to make the compatibility and privacy findings required for the granting of design review approval, based upon the following considerations: (a) The existing residences within the immediate neighborhood are primarily single-story. The proposed two-story addition would not be compatible with these structures. (b) The applicants' lot is larger than the minimum size prescribed for the R-l-10,000 zoning district in which it is located, being 15,531 square feet. There is sufficient room for the construction of a single-story addition in the large rear yard. (c) The proposed second story addition would interfere with the privacy of adjacent property owners since the existing mature landscaping would not provide adequate screening. 3. The staff report to the Site Review Committee, dated September 10, 1986, recommending denial of the application, is hereby approved and incorporated herein by reference. -1- The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the ~.rd day of December, 1986, by the following vote: AYES: Councihnenke_rs Anderson, Clevenger, MDyles, Peterson, and Mayor Hlava NOES: None ABSENT~one ~ C~May°r ATTEST: City C~erk~ -2-
