HomeMy WebLinkAboutCity Council Resolution 2393 RESOLUTION NO. 2393 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA FINDING AND DETERMINING THAT A SALE OR LEASE OF THE CITY OWNED PROPERTY LOCATED AT THE SOUTHEAST CORNER OF COX AVENUE AND 8ARATOGA/SUNNYVALE ROAD IS REQUIRED FOR THE PUBLIC INTEREST AND CONVENIENCE, DECLARING THE INTENTION OF THE COUNCIL TO SELL OR LEASE SAID PROPERTY, AND FIXING THE TIME FOR HEARING ANY PROTESTS THERETO WHEREAS~ the City of Saratoga is the owner of certain unimproved real property located at the southeast corner of Cox Avenue and Saratoga/Sunnyvale Road, consisting of approximately 2.75 acres of land as more particularly described in Exhibit "A" attached hereto and made a part hereof; and WHEREAS, said property is not intended to be used by the City for the construction of any public facilities thereon and constitutes surplus land; and WHEREAS, a sale or lease of said property for development as a multi- family project or a mixed project containing multi-family and retail commercial uses will generate additional revenue for the City and alleviate the problem of raising such revenue through other means which now have been severely restricted by state laws; and WHEREAS, by Resolution adopted on December 10, 1986, the City Planning Commission found and determined that the proposed disposition of said property will conform with the City's General Plan and such determination has been reported to the City Council in accordance with Section 65402(a) of the California Government Code, NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Saratoga as follows: 1. The City Council does hereby find and determine that a sale or lease of the City owned real property located at the southeast corner of Cox Avenue and Saratoga/Sunnyvale Road, as hereinabove described, is required for the public interest and convenience and does hereby declare its intention to sell or lease said property. 2. A public hearing on the proposed sale or lease of said property is hereby scheduled to be conducted at the regular meeting of the City Council to be held on January 21, 1987, commencing at 7:00 p.m., or as soon thereafter as the matter can be heard, at the Saratoga City Council Chambers, 13777 Fruitvale Avenue, Saratoga, California, at which time any interested person will be afforded the opportunity to protest the intended sale or lease of said property. Written protests may be delivered to the City Clerk prior to such hearing and both written and oral protests may be communicated to the City Council at the time of the hearing. -1- 3. Final action on the proposed sale or lease of said property will be taken during the regular meeting of the City Council at which the public hearing is concluded, or on such later date as may be announced at such meeting. 4. A copy of this Resolution shall be published once in the Saratoga News and posted for not less than ten days prior to the public hearing in at least three conspicuous places upon said property, in accordance with Section 37423 of the California Government Code. Passed and adopted at a regular meeting of the City Council of the City Saratoga held on the 17th day of December, 1986, by the following vote: AYES: Councils Anderson, Clevenger, F~yles, Peterson, and Mayor Hlava NOES: Nc~e ABSTAINNone ABSENT: None ATTEST: City Clerk -2- E X H I B I T "A" All that certain real property situate in the City of Saratoga, County of Santa Clara, State of California, described as follows: Portion of the Quito Rancho, described as follows: Beginning in the center line of Cox Road, 40 feet wide, of the center line of Saratoga-Sunnyvale Road, formerly called Saratoga and Mountain View Road, 60 feet wide, as said roads are shown upon the Map of Tract No. 1489 Argonaut Place Unit No. 3, filed July 12, 1955, Book 59 of Maps 30; thence alon~ said center line of Cox Road, S. 87 deg. 09~ 45" E. 468.91 feet to the Northwest corner of the land shown upon the Map of Tract No. 2804 filed September 15, 1960, Book 125 of Maps, page 23, thence along the Westerly line of said Tract No. 2804, S. 1 deg. 03~ 27" W., 326.82 feet to the Westerly prolongation of one of the Northerly lines of said Tract No. 1489 Argonaut Place Unit No. 3, thence along said line, N. 87 deg. 02~ 05" W., 469.16 feet to said center line of Saratoga-Sunnyvale Road thence along said center line N. I deg. 05~ 40" E., 325.76 feet to the point of beginning.
