EESOLUTION OF THE CiTY COUNCIL OP THE CITY OF
8AEATOGA UPHOLDING A DECISION OF THE PLANNING
COMMISSION
WHEREAS, Joseph Kovaes, the applicant, has applied to the City of
Saratoga fee an encroachment permit to construct a fence within the public right-of-
way adjacent to his property located at 14280 Paul Avenue, such application being
identified as EP-87-001, and
WHEREAS, on February 25, 1987, the Planning Commission of the City of
Saratoga considered said application and approved the same, subject to a condition
that the fence height be reduced to 3 feet; and
WHEREAS, the applicant has appealed the height condition imposed by the
Planning Commission to the City Council; and
WHEREAS, on April 1, 1987, the City Council conducted a de novo hearing
on the appeal, at which time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in support
of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on April 1, 1987~ by a vote of 4-0 with councilmember Peterson absent, did
resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed.
2. The Council found and determined that the height condition was
reasonable and necessary for safety reasons, as similarly determined
by the Planning Commission, and also was consistent with the newly
adopted zoning regulations restricting the height of fences within
front yards to not more than three feet.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 15th day of
April 1987, by the foilowing vote:
AYES: Councilmembers Anderson, Clevenger, MDyles, Peterson and Mayor Hlava
