A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SARATOGA AUTHORIZING THE SUBMISSION OF CONVENIENCE
ZONE EXEMPTION REQUEST FORMS TO CALIFORNIA DEPARTMENT
OF CONSERVATION, DIVISION OF RECYCLING
WHEREAS, the City of Saratoga has provided public notice of the
City's intent to request an exemption from the convenience zone
requirements of the California Beverage Container Recycling and
Litter Reduction Act for West Valley Kiwanis Recycling Center;
and
WHEREAS, on July 15, 1987, a public hearing was held and
testimony was received regarding public support or opposition to
the proposed action; and
WHEREAS, the City of Saratoga has evaluated and identified
alternative recycling locations available to the consumer to
conveniently return beverage containers for the redemption value
and redemption bonus; and
WHEREAS, the City of Saratoga has reviewed the exemption
criteria, completed the exemption request form, and listened to
and responded to all public testimony regarding the exemption
proposal; and
WHEREAS, the City of Saratoga has determined that, if granted,
the proposed exemption to convenience zones #2432 and #2433 will
not significantly decrease the ability of consumers to return
beverage containers for the redemption value and any applicable
redemption bonus; and
WHEREAS, the City of Saratoga has responded to all of the
requirements of the state regulations governing exemption of
convenience zones.
NOW, THEREFORE, BE IT RESOLVED that the City of Saratoga
authorizes the Community Services Department to submit the
exemption request to the Chief of the Division of Recycling,
State of California.
The above and foregoing resolution was passed and adopted at a
regular meeting of the City Council of the City of Saratoga held
on the 15th day of July, 1987, by the following vote:
AYES: Councilmembers Anderson, Clevenger, Hlava, FEyles and Mayor Peterson
