RESOLIrI~ON OF THE CITY COUNCIL
OF THE CITY OF SARATOGA
UPHOLDING A DEC'~ON OF THE PLANNING COMMISSION
WHEREAS, RICHARD RIVOIR, the applicant, has applied to the City of
Saratoga for approval of a reversion to acreage and lot line adjustment to establish
4 lots where 9 currently exist and for tentative building site approval for 3 existing
lots, all of such lots constituting a subdivision located at 20411 Hill Avenue, such
applications being identified as LL-87-003, SD-87-009 and SD-87-009.1, and
WHEREAS, on July 22, 1987, the Planning Commission of the City of Saratoga
conducted a public hearing on said applications, and following the conclusion
thereof, the Planning Commission approved the applications, and
WHEREAS, Audrey S. Smith has appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on September 2, 1987, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given
an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council in
support of and in opposition to the appeal;
NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting
on September 2, 1987, by a vote of 5-0, did resolve as follows:
1. The appeal from the Planning Commission was denied and the decision of
the Planning Commission was affirmed.
2. The City Council concurred with the findings and conclusions of the
Planning Commission and the staff report and the same are adopted and
incorporated herein by reference.
3. Denial of the appeal was expressly eonditioned upon the submission by
the applicant of a revised map showing the reloeation of Pleasant Street
so as to intersect Hill Avenue approximately 30 feet east of the present
location, and approval of such revised map by the Planning Director, the
City Engineer and the City Council.

The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 16th day of
September, 1987, by the following vote:
AYES: Councilmembers Anderson, Clevenger, Hlava and Mayor Peterson
