RESOLUTION OFTHE CITY COUNCIL
OF THE CITY OF SARATOGA
UPHOLDING
A DECISION OF THE PLANNING COMMISSION
WHEREAS, MAURICE BRONER, the applicant, has applied to the City of
Saratoga for a use permit to construct a pool enclosure within a required side
and rear yard setback, on property located at 12246 Via Roncole, such applica~
tion being identified as UP-87~012, and
WHEREAS, on July 8, 1987, and August 12, 1987, the Planning Commission
of the City of Saratoga conducted a public hearing on said application, and
following the conclusion thereof, the Planning Commission approved the
application; and
WHEREAS, Lavadia Palmer has appealed the decision of the Planning Com~
mission to the City Council; and
WHEREAS, on October 7, 1987, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was
given an opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
application, and the written and oral evidence presented to the City Council
in support of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting
on October 7, 1987, by a vote of 3 ~ 2 with councilmember(s) Clevenger and
Anderson dissenting, did resolve as follows:
1. The appeal from the Planning Commission was denied and the deci~
sion of the Planning Commission was affirmed.
2. The Council found and determined that the impact of the structure
has been adequately mitigated by increasing the side yard setback,
reducing the size and height of the structure, and requiring
drainage measures to prevent water rungoff on the adjacent
property. The Council accepted the findings and conclusions of
the Planning Commission and the Staff Report dated August 12,
t987, and the same are incorporated herein by reference.
The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga on the 21st day of
October, 1987, by the following vote:
AYES: Councilmen~rs Anderson, Clevenger, Hlava, MDyles, and Mayor Peterson
