VACATING A STORM DRAIN EASEMENT
WHEREAS, a Resolution of the City Council of the City of Saratoga of Intention
to Vacate a Storm Drain Easement on Lot 64 of Tract 3439 was noticed, heard and
approved by the City Council on December 16, 1987; and
WHEREAS, the City Council scheduled a public hearing on said proposed
vacation for January 6, 1988; and
WHEREAS, notice of the public hearing was published and posted pursuant to
California Streets and Highways Code Section 8323; and
WHEREAS, the public hearing on said vacation was held on January 6, 1988, at
which time any person interested in the matter was given the opportunity to be heard;
and
WHEREAS, the City Council found and determined that said storm drain
easement was no longer necessary for present or prospective public use,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SARATOGA
HEREBY RESOLVES AS FOLLOWS:
[Z 1. Pursuant to the authority of Chapter 3 (commencing at Section 8329) of
· I ~ Part 3 of Division 9 of the California Streets and Highways Code, the storm
3Z ~ 13 drain easement on Lot 64 of Tract 3439 as identified, described and delineated
_ ~J) on that certain Map recorded and filed in Book 163 of Maps, at pages 40 and 41,
UJ ~: *~ in the Office of the County Recorder of the County of Santa Clara, State of
t21 U2 t~~ C3 California, on July 9, 1963, is hereby vacated.
~_ ~ 2. From and after the date this Resolution is recorded, the above
UJ described storm drain easement shall no longer constitute such an easement.
L~ O ~) I~ 3. The City Clerk is hereby authorized and instructed to cause a certified
I~-. ~.1 . CI copy of this Resolution, attested by the City Clerk under seal, to be recorded

The foregoing Resolution was passed and adopted at a regular meeting of the
City Council of the City of Saratoga held on the 6th day of January, 1988, by the
