HomeMy WebLinkAboutCity Council Resolution 2477 RESOLUTION NO.2477 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA AUTHORIZING THE CITY MANAGER TO NEGOTIATE AN AGREEMENT TO PROVIDE LOCAL LAW ENFORCEMENT AGENCY ACCESS TO THE CALIFORNIA IDENTIFICATION SYSTEM AND TO APPROPRIATE AND SEND THE CITY OF 8ARATOGA'S FINANCIAL CONTRIBUTION FOR THE SYSTEM TO THE CITY OF SAN JOSE FINANCE DEPARTMENT WHEREAS, Senate Bill 190 (Ch. 1234 of the 1985-86 Legislative Session, codified as California Penal Code Section 11105, 11112.1 and following) provides for funding and procedures allowing local agencies direct access to the California Identification System (nCal-ID Systemn), an automated system maintained by the California State Department of Justice for retaining fingerprint files and identifying latent fingerprints~ and WHEREAS, the County of Santa Clara (-County-) and each of the incor- porated cities within Santa Clara County (nIncorporated Cities") have determined that it is in their best interest to cooperate in the imple- mentation and operation of a local automated fingerprint identification system ("Local ID System-) which will provide local law enforcement agencies with direct access to the Cal-ID system through the use of local remote access network equipment ("local RAN equipment")~ and WHEREAS, the County and each of the incorporated cities desire to enter into an agreement for the implementation and operation of the Local ID System for the benefit of the citizens of their jurisdictions, and to participate in the System, and to declare their commitment to share financially in the System. NOW, THEREFORE, BE IT RESOLVED by the Council of the City of Saratoga: 1. The City Manager is authorized to negotiate an agremeent with the County and the Incorporated Cities to provide local law enforcement agency access to the Cal-ID System. 2. The City Hanager is authorized to appropriate and send to the City of San Jose Finance Department the City of Saratoga,s financial contribu- tion of twenty thousand three hundred twenty-eight and 22/100 dollars ($20,328.22) for the Local ID System, which includes the City of Sara- toga,s contribution towards the System,s estimated start-up, implementa- tion, and equipment costs and the estimated operating costs for Fiscal Year 1988-89. The above and foregoing resolution was passed and adopted by the Saratoga City Council at a meeting held on the 20th day of April, 1988, by the following vote: AYES: Councfimembers Anderson, Clevenger, Hlava, Moyles'and Mayor Petarson NOES: None ./~~~~ ABSENT ~ox~ Deputy City er
