HomeMy WebLinkAboutCity Council Resolution 2489 RESOLUTION NO..- 2489 RESOLUTION OP THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING A DECISION OF THE PLANNING COMMISSION WHEREAS, ERNEST WESTBROOK, the applicant, has applied to the City of Saratoga for design review approval to construct an addition to an existing single family residence located at 20601 Lomita Avenue, such application being identified as DR-87-114, and WHEREAS, on December 9, 1987, and April 13, 1988, the Planning Commission of the City of Saratoga conducted a public hearing on said application, and following the conclusion thereof, the Planning Commission denied the application; and WHEREAS, the applicant has appealed the decision of the Planning Commission to the City Council; and WHEREAS, on June 1, 1988, the City Council conducted a de novo public hearing on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports, minutes of proceedings conducted by the Planning Commission relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga, at its meeting on June 1, 1988, by a vote of 5-0 did resolve as follows: 1. The appeal from the Planning Commission was denied and the decision of the Planning Commission was affirmed. 2. The Council agreed with the "Findings for Denial," as set forth in Exhibit "B" attached to the Staff Report to the Planning Commission dated April 13, 1988, and the same are incorporated herein by reference. The Council found and determined that: (1) The proposed total square footage on the site of 3,118 square feet would be excessive, particularly since the lot is substandard in size. This square footage, coupled with the proposed design, results in an excessively bulky and massive appearance of the structure. (2) The proposed addition will aggravate the adverse privacy and view impacts upon the adjacent property by reason of the long elevation, continuous roof line, and close proximity to the property line. -1- (3) The addition is being made to the second story of the structure, as opposed to being stepped down or at the ground level. As such, the addition will interfere with the light, air and solar access of the adjacent property. *** The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 15th day of June, 1988, by the following vote: AYES: CouncilmeK'uers Anderson, Clevenger, Hlava, Moyles and Mayor Peter~n NOES: None ABSENT:None /'~ ATTEST: City Clerk / -2-
