RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA
ACCEPTING OFFER OF DEDICATION
WHEREAS, an offer of dedication of easement for storm drainage
and control has been made pertaining to certain real property
situated in the City of Saratoga, County of Santa Clara, State of
California, and
WHEREAS, such offer of - dedication, together with the legal
description of such property, is attached as Exhibit "A" hereto
and made a part hereof, and
WHEREAS, the offer of dedication pertaining to said easement has
never been accepted by either the County .of Santa Clara or the
City of Saratoga, and
WHEREAS, the City Council has determined that acceptance of the
offer of dedication pertaining to said easement would be in the
public interest

NOW, THEREFORE, the City Council of the City of Saratoga hereby
accepts the offer of dedication with respect to the easement
hereinabove described and shown on Exhibit A attached hereto.
~The City Clerk is hereby authorized and directed to record a
~certified copy of this resolution in the Office of the Recorder
for Santa Clara County California.
(The above and foregoing resolution was passed and adopted by the
Saratoga City Council at a meeting held on the 15th day of June,
1988, by the following vote:

For valuable consideration, the UNDERSIGNED OWNERS of the herein-
after described real property, hereby warranting that they constitute
all of the owners thereof, for themselves, their heirs,' successors and
assigns, hereby irrevocably offer to dedicate to the CITY OF SARATOGA, "
a Municipal Corporation, an easement for storm water drainage and con-
trol under, over, and across that certain real property situated in
the City of Saratoga, County of Santa Clara, State of California. Said
property is more particularly described as follows:
DESCRIPTION
Commencing at a point in the present northwesterly 1 ine o~ Lumber Street·
.(Big Basin ~4ay) distant thereon southwesterly 50 feet from the southwest-
erly line of that certain parcel of land deeded to Howard 14. Mills by Daniel
Carmichael by deed dated September 25, 1913, and recorded in Book 411 of
Deeds, page 5l in the Office of the County Recorder of Santa Clara County,
Cal ifornia, running thence southwesterly along the northwesterly 1 ine of
Lumber Street (Big Basin Way) 50 feet; thence leaving said line and running
northwesterly and parallel with the southwesterly line of land so conveyed
to Mills and the northwesterly prolongation of said line lg5 feet to the
true point of beginning of this description: Thence continuing northwest-
erly along the said line llO feet, more or less, to the center li'ne of the
Campbell or Quito Creek and Northwesterly 1 ine of that certain parcel of
land conveyed by Maria Minzel to Daniel Carmichael by deed dated May 2,
lglE and recorded May 2, 1912 in Book 384 of Deeds at page235 Santa Clara
County records; running Che~ce northeasterly and along said last named"l~neI
50 feet, more or less, to the point of intersection thereof with a line drawn-
northwesterly from, the point of connencement to this d~scription and parallel
with the second course thereof; thence Southeasterly on a line towards the point
of the commencement of this description, llO feet; thence southwesterly and par-
allel with the northwesterly line of Lumber Street (Big Basin Way) 50 feet to
the true point of beginning of this description.
Containing 5,500 square feet more or less. "
The UNDERSIGNED understands that the within offer can only be accepted by..
resolution of the City CoSncil of the City of Saratog~ and recordation of thi.s
instrument shall not and will not consititute acceptance of the within offer to
dedicate. This offer shall be irrevocable and shall be binding upon our heirs,
personal representatives, successors and assigns. The plural 'as used herein
shall include th.e singular, and~~gular shall include the plural;
