HomeMy WebLinkAboutCity Council Resolution 2536 Pa~OL~ON NO.: 2536 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA UPHOLDING AN ADMINISTRATIVE DECISION OF THE CITY ENGINEER WHEREAS, SHELDON BLUM, the applicant, has applied to the City Engineer for the City of Saratoga for a stockpiling permit to retain fill material illegally placed upon property located on Deer Springs Court, identified as APN 503- 28-120, and WHEREAS, on November 18, 1988, such application was denied by the City Engineer, and WHEREAS, the applicant has appealed the administrative decision of the City Engineer to the City Council; and WHEREAS, on December 7, 1988, the City Council conducted a de novo review on the appeal, at which time any person interested in the matter was given an opportunity to be heard; and WHEREAS, the City Council reviewed and considered the staff reports relating to said application, and the written and oral evidence presented to the City Council in support of and in opposition to the appeal, NOW, THEREFORE, the City Council of the City of Saratoga~ at its meeting on December 7, 1988, by a vote of 3-1, with Councilmember Peterson dissenting and Councilmember Moyles absent, did resolve as follows: 1. The appeal from the administrative decision of the City Engineer was denied and the decision of the City Engineer was affirmed. 2. The Council agreed with the determination by the City Engineer that the fill constituted a hazard to adjacent properties and drainage facilities and also was unsuitable material to be used for fill purposes. 3. The applicant was ordered to remove all of the illegally placed fill material within ten working days from December 7, 1988. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 21st day of December, 1988, by the following vote: -1- A YES: CounciLmembsrs Clevenger ~ ~Dyles, Peter~Dn and Mayor Anderson NOES: None ABSENT: Co~mci~ Stutzman ATT3 ~.ST: -2-
