HomeMy WebLinkAboutCity Council Resolution 399-7 RESOLUTION NO. 399-7 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORMATION OF AN UNDERGROUND UTILITY DISTRICT ON BIG BASIN WAY/ CONGRESS SPRINGS ROAD BETWEE~ FIFTH STREET AND HAKONE GARDENS BE IT RESOLVED by the Council of the City of Saratoga, as follows: WHEREAS, Ordinance No. 38.20 establishes a procedure for the creation of under- ground utility districts and requires as the initial step in such procedure the hold- ing of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead struc- tures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district~ and WHEREAS, it has been recommended that such underground utility district, herein- after called District, be formed on Big Basin Way/Congress Springs Road between Fifth Street and Hakone Gardens. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the Council of the City of Saratoga on August 17, 1988, at the hour of 8:00 o'clock P.M. in the Council Chambers of the City Hall, 13777 Fruitvale Avenue, Saratoga, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated overhead structures and the underground install- ation of wires and facilities for supplying electric, comm_,nication, or similar assoc- iated service in the District hereinabove described. 2. At such hearing, all persons interested shall be given an opportunity to be heard. Said hearin~ my be continued from time to time as may be determined by the City Cguncil. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities concerned at least ten (10) days prior to the 'date thereof. 4. The area proposed to be included in the District is shown upon that certain map entitled Saratoga Underground Utility District #6, dated June 1988 which is on file in the office of the City Clerk of the City of Saratoga. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 3rd day of August , 1988, .by the following vote: AYES: Council,embers Clevenger, MDyles, Peterson~ Stutnnan and Mayor Anderson NOES: NoIle ABSENT: Nolle ATTEST: CITY CLERK
