PJ~SOLUT~ON OP THE CFTY COUNCIL OF THE
CITY OF SARATOGA UPHOLDING A DECESION OF
THE PLANNING COMMESSION
WHEREAS, DONALD and JOANNE PROLO, the applicants, have applied to
the City of Saratoga for design review approval to construct a 2,013 square foot
addition to an existing residence located at 19841 Glen Una Drive and variance
approval to exceed the allowable floor area by 2,342 square feet, and
WHEREAS, on January 11, 1989, and January 25, 1989, the Planning
Commission of the City of Saratoga conducted a public hearing on said applications,
and following the conclusion thereof, the Planning Commission approved the
applications; and
WHEREAS, Donald Peterson has appealed the decision of the Planning
Commission to the City Council; and
WHEREAS, on March 1, 1989, the City Council conducted a de novo public
hearing on the appeal, at which time any person interested in the matter was given an
opportunity to be heard; and
WHEREAS, the City Council reviewed and considered the staff reports,
minutes of proceedings conducted by the Planning Commission relating to said
applications, and the written and oral evidence presented to the City Council in
support of and in opposition to the appeal,
NOW, THEREFORE, the City Council of the City of Saratoga, at its
meeting on March 1, 1989, by a vote of 4-8 with Councilmember Paterson abstaining,
did resolve as follows:
1. The appeal from the Planning Commission was denied and the
decision of the Planning Commission was affirmed.
2. The City Council agreed with the findings and determinations made
by the Planning Commission for the granting of design review and
variance approval, as set forth in Planning Commission Resolutions
DR-88-100 and V-88-043 adopted on February 8, 1989, and such
Resolutions are incorporated herein by reference. The City Council
further noted that: the subject property was located within a
distinctive area of the City characterized by large homes; the site
was unique by being surrounded on three sides by streets; the addition
was designed to achieve geometrical symmetry of the structure and
did not result in any perceptible increase of bulk or mass; and no
adverse impacts were claimed by the neighbors. For these reasons,
the approvals could be granted without establishing a precedent in
other eases.

The above and foregoing resolution was passed and adopted at a regular
meeting of the City Council of the City of Saratoga held on the 15th day of
March 1989, by the following vote:
