RESOLUTION OF THE CITY COUNCIL OF T~E CITY OF SARATOGA
CONFIRMING THE ZONING CLASSIFICATION OF CERTAIN PROPERTIES
ANNEXED TO THE CITY
WHEREAS, on October 28, 1985, the City annexed that certain
property located at 19288 Bainter Avenue (hereinafter referred to
as the "Bainter Property"); and
WHEREAS, at the time of such annexation, the zoning regulations
of the City provided that any hillside property annexed to the
City shall be given the zoning classification of HC-RD (Hillside
Conservation Residential District), and it was the intention of
the City Council to assign such zoning category to the Bainter
property; and
WHEREAS, on April 4, 1989, the City annexed that certain property
located at 15839 Hidden Hill Road (hereinafter referred to as the
"Hidden Hill Property"), which is located immediately adjacent to
the Bainter Property; and
WHEREAS, at the time the Hidden Hill Property was annexed the
zoning regulations of the City provided that property annexed to
the City shall be given the zoning classification of the district
adjacent to such property; and
WHEREAS, because the Midden Hill Property is adjacent to the
Bainter Property having the HC-RD Classification the Hidden Hill
property should similarly be classified as HC-RD, and it was the
intention of the City Council to assign such classification to
said property at the time of annexation; and
WHEREAS, the zoning map of the City erroneously designates the
Bainter property and the Hidden Hill property as R-i-40,000,
rather than the proper designation of HC-RD,
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Saratoga as follows: ·
1. The Council hereby acknowledges and confirms that the proper
zoning classification for the Bainter Property and the Hidden
Hill Property is HC-RD and that such classification has been
applied to such properties since the date each was respectively
annexed to the City.
2. The Planning Director is authorized and instructed to
correct the zoning map to show the Bainter Property and the
Hidden Hill property as having a zoning classification of HC-RD.
The above and foregoing resolution was passed and adopted by the
Saratoga City Council at a meeting held on the 5th day of July,
1989, by the following vote:
