HomeMy WebLinkAboutCity Council Resolution 399-9 RESOLUTION NO. 399.9 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SARATOGA CALLING A PUBLIC HEARING TO DETERMINE WHETHER PUBLIC NECESSITY, HEALTH, SAFETY, OR WELFARE REQUIRES THE FORM- ATION OF AN UNDERGROUND UTILITY DISTRICT ON OAK STREET BETWEEN SARATOGA-LOS GATOS ROAD AND KOMINA AVENUE: AND SARATOGA-LOS GATOS ROAD BETWEEN OAK PLACE AND BIG BASIN WAY/SARATOGA AVENUE BE IT RESOLVED by the Council of the City of Saratoga, as follows= WHEREAS, Ordinance No. 38.20 establishes a procedure for the creation of underground utility districts and requires as the initial step in such procedure the holding of a public hearing to ascertain whether public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated over- head structures and the underground installation of wires and facilities for supplying electric, communication, or similar or associated service in any such district; and WHEREAS, it has been recommended that such underground utility district, hereinafter called District, be formed on Oak Street between Saratoga-Los Gatos Road and Komina Avenue; and Saratoga- Los Gatos Road between Oak Place and Big Basin Way/Saratoga Avenue. NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS= 1. NOTICE IS HEREBY GIVEN that a public hearing will be held by the Council of the City of Saratoga on October 4, 1989, at the hour of 8=00 ofclock P.M. in the Council Chambers of the City Hall, 13777 Fruitvale Avenue, Saratoga, California, to ascertain whether the public necessity, health, safety, or welfare requires the removal of poles, overhead wires and associated over- head structures and the underground installation of wires and facilities for supplying electric, co~munication, or similar associated service in the District hereinabove described. 2. At such hearing, all persons interested shall be given an opportunity to be heard. Said hearing may be continued from time to time as may be determined by the City Council. 3. The City Clerk shall notify all affected property owners as shown on the last equalized assessment roll and utilities con- cerned at least ten (10) days prior to the date thereoZ. 4. The area proposed to be included in the District is shown upon that certain map entitled Saratoga Underground Utility District #?,'dated August 1989 which is on file in the Office of the City Clerk of the City of Saratoga. The above and foregoing resolution was passed and adopted at a regular meeting of the City Council of the City of Saratoga held on the 6th day of September ~ , 1989, by the follow- ing vote= AYES: Collrlcil~s AIldersoI~, ~4oyles, Stut~nan and }i~yor Clevenger NOES: None ABSENT.~cmmcilmember Petersen ~YO~ UCITY CLERK
