A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SARATOGA WAIVING COMPETITIVE BIDDING
(PIERCE ROAD BRIDGE IMPROVEMENTS)
RECITALS
WHEREAS, the pierce Road Bridge, Bridge No. 37C-293 was
closed on March 3, 1992 after a determination made by structural
engineers for the California Department of Transportation that
the bridge was unsafe for any vehicular traffic due to a lack of
structural integrity along the northerly abutment of the bridge;
and
WHEREAS, engineering analyses have concluded that in order
to make the bridge safe for all vehicular traffic it must be
reconstructed to meet current engineering design standards, and
the only cost effective means of doing so is to replace the
entire bridge¡ and
WHEREAS, the bridge replacement is an eligible project to
receive funding through the Federal Highway Bridge Replacement
and Rehabilitation Program; and
WHEREAS, due to the length of time involved in obtaining
state and federal design approval necessary for funding of the
project through the Federal Program/ commencement of construction
of the bridge replacement could be delayed until Spring 1993; and
WHEREAS, due to the closing of the pierce Road Bridge the
established traffic circulation patterns for the surrounding
hillside residential areas have been modified by the forced
detour of all traffic normally using this bridge through
approximately 1 1/2 miles of hillside residential streets/
resulting in a substantial increase in potential points of
traffic conflict along said streets and intersections; and
WHEREAS, the City Manager has recommended the City Council
waive the requirement of competitive bidding for the design and
construction of an interim structural support scheme which would
allow the temporary reopening of the bridge with restricted
weight limits; and
WHEREAS, Saratoga Municipal Code section 2-45.120(b) (1)
allows the waiver of competitive bidding requirements upon a
determination by the City Council that the immediate preservation
of the public peace, health or safety requires such waiving.

NOW, THEREFORE, be it RESOLVED by the city council as
follows:
1. The Council finds that the immediate preservation of
the public peace/ health or safety requires the waiver
of the requirement of competitive bidding for the
design and construction of an interim structural
support scheme in order to allow the temporary
reopening of the Pierce Road Bridge to vehicular
traffic with restricted weight limits, thereby
alleviating the increase in traffic conflicts through
neighboring hillside residential streets.
2. The City Engineer is authorized to negotiate a price
for the aforesaid services without the need for
competitive bidding.
