RESOLUTION APPLYING VEHICLE CODE
REGULATIONS TO PRIVATE ROAD
WHEREAS, there exists within the City of Saratoga a
hereinafter described private road which, after petition, notice,
and public hearing this Council finds and determines should be
subject to the provisions of the Vehicle Code of the State of
California as hereinafter set forth,
NOW, THEREFORE, under and pursuant to Vehicle Code Section
21107.7 of the State of California, the City Council of the City of
Saratoga hereby resolves as follows:
Section 1: There has heretofore been filed with this City
a petition signed by a majority of the owners
of the following described privately owned and maintaine~
road located within the City of Saratoga, to-wit:
San Marcos Road
requesting a finding and determination as hereinafter set
forth, and the adoption of the within Resolution, and
pursuant to said petition thereafter a public hearing has
been held on the same by this Council, after ten (10) days
prior written notice to all the owners of said private
road, and after said hearing this Council hereby finds $~z]
declares that said road is a privately owned and maintained
road within this City, which is not generally held open
for use of the public for purposes of vehicular traffic,
but by reason of its proximity to and connection with
Fruitvale Avenue the interests of the residents residing
along said road and the motoring public would best be
served by application of the provisions of the Vehicle Code
of the State of California to such road.
Section 2: By reason of the foregoing, this Council hereby
finds, determines and declares that henceforth
the provisions of the Vehicle Code of the State of California
shall apply to said San Marcos Road, and the Director of
Public Works is hereby authorized and directed to install
appropriate signs at all entrances to said road in such size,
shape and color as to be readily legible during daylight
hours from a distance of 100 feet, said signs to state in
effect that the road is subject to the regulations and
provisions of said Vehicle Code.
The above and foregoing Resolution was passed and adopted at
a regular meeting of the .City Council of the City of Saratoga held

on the 17th day of May , 1972, by the following
vote:
AYES: Councilmen Smith, Bridges, Kraus and Diridon
NOES: None
ABSENT: Councilman Dwyer

NOTICE IS HEREBY GIVEN that the City Clerk and Ex-officio Clerk
of the Saratoga City Council, State of California, has set the hour of
8:00 P.M,, on Wednesday, the 17th day of May, 1972, in the City
Council Chambers, 13777 Fruitvale Avenue, Saratoga, California, as the
time and place for public hearing on:
Making the State Vehicle Code applicable and enforceable on
San Marcos Road, under Section 21107 and Section 21107.7 of
the Vehicle Code pertaining to private roads,
a copy of which application is on file at the office of the Saratoga
City Council at 13777 Fruitvale Avenue, Saratoga, California.
ALL INTERESTED PERSONS may appear and be heard at said time and
place. Written communications should be filed on or before Thursday,
May 11, 1972.
